Super Bowl ‘Wardrobe Malfunction’ fines tossed out.

Are we the only ones who didn’t even notice this during the Super Bowl a couple of years ago? Perhaps it was the delicious combination of jalapeño poppers and ‘tequilatinis’, but if the media didn’t make such a giant deal about it…who would have ever even known or cared? But we digress…

Associated Press is reporting that a federal appeals court on Monday threw out a $550,000 indecency fine against CBS Corp. for the 2004 Super Bowl halftime show that ended with Janet Jackson’s breast-baring “wardrobe malfunction.”

The three-judge panel of the 3rd U.S. Circuit Court of Appeals ruled that the Federal Communications Commission “acted arbitrarily and capriciously” in issuing the fine for the fleeting image of nudity.

So, even if we are still a Puritanical country to a certain extent, it’s good to know judicial stupidity is on the decline.
